Legislative Update for PeopleSoft HCM - California Data Privacy Update

California has recently passed the United States toughest data privacy law “The California Consumer Privacy Act of 2018 (AB378)”.  Similar to GDPR (General Data Protection Regulation) in the European Union, it gives consumers more control over the use of their data.  For any company that has assets in California or handles Californians’ personal information, California’s new Consumer Privacy Act of 2018 will likely have an impact on an origination’s business operations. 
Organizations around the world have to comply with the California Consumer Privacy Act if they receive personal data from California residents and if they — or their parent company or a subsidiary — exceed one of three thresholds: (a) annual gross revenues of $25 million; (b) obtains personal information of 50,000 or more California residents, households or devices annually; or (c) 50 percent or more annual revenue from selling California residents’ personal information. Parent companies and subsidiaries using the same branding are covered in the definition of "business," even if they themselves do not exceed the applicable thresholds.
As written, the California Consumer Privacy Act of 2018 requires the following:
·         The new law grants consumers the right to know what information companies are collecting about them, why they are collecting that data and with whom (3rd parties) they are sharing it.
·         Gives consumers the right to tell companies to delete their information as well as to not sell or share their data.
·         It also makes it more difficult to share or sell data on children younger than 16.
The California Consumer Privacy Act of 2018 legislation is similar to the GPDR law which went into effect May 2018.  To assist organizations with managing data privacy, Oracle has delivered several new features within PeopleSoft HCM like Employee and Applicant Delete (right to be forgotten), Acknowledgement Framework (for consent).  For additional information on the delivered data privacy features – https://blogs.oracle.com/psftlegupdates/peoplesoft-hcm-data-privacy-update
Failure to comply with these new laws could be costly to businesses with civil penalties resulting from an action by the state attorney general of up to $7,500 per violation. 
The legislation,  goes into effect in January 1st, 2020

Actualización legislativa para PeopleSoft Global Payroll España (Nómina)

El Gobierno de España publicó el Real Decreto 1077/2017 que establece el salario mínimo para 2018. El nuevo valor del salario mínimo probablemente afecte las bases y las tasas mínimas de la Seguridad Social. Oracle ha avanzado esos valores como parte de la segunda actualización de entrega de impuestos para 2018.

Adicionalmente, esta actualización legislativa contenía la reacción al Decreto Foral 62/2017 (Alava), el Decreto Foral 31/2017, (Guipúzcoa) y el Decreto Foral 152/2017 (Vizcaya) que establecen las nuevas tasas impositivas para 2018 para esos Territorios Históricos.

Oracle está trabajando actualmente en los cambios para cumplir con la nueva plantilla para el Informe de Deducción Fiscal (Modelo 10T) y también sobre los cambios en el informe XML a la Fundación Tripartita para 2018.

El "Position Statement" de Oracle se ha revisado para incluir más detalles sobre estas actualizaciones legislativas, la disponibilidad del parche y los requisitos previos. Aconsejamos a los clientes que revisen la declaración de posición para mantenerse actualizados.

Actualización legislativa para la Nómina de España: Legislative Update for PeopleSoft Global Payroll Spain

As result of the publication of Orden Foral 676/2017, Oracle has delivered Tax Update (#9) containing the changes to comply with the technical requirements for the reporting of Model 190 for 2017 for the State fiscal territory.

Hacienda Foral de Alava and Hacienda Foral of Vizcaya have also published Orden Foral 676/2017 and Orden Foral 2190/2017 with the requirements for the Model 190 reporting for 2017 following the same approach than the State Fiscal Territory. We expect the other historical territories will follow the same. Oracle has delivered Tax Update (#10) with the changes on Model 190 for 2017 for all the Historical Territories.

Additionally, Oracle is working on the changes on the AFI file to comply with the latest version of Winsuite 8.7.0, in the new template for the Tax Deduction Report (Model 10T) and also on the changes on the XML reporting to Fundación Tripartita for 2018.

Status sobre Mantenimiento Legislativo de PeopleSoft para España



As part of the Legislative Maintenance for Spain, Oracle has delivered:
  • Changes to react to the new format of the Model 10T (Certificado de retenciones e Ingresos a cuenta) delivered by the Tax Agency (Tax Update 2º Delivery 2017)
  • Tax update to reflect in the product a set of changes affecting Training reporting as result of the new requirements published on the Tripartite foundation website for the XML files supported by the product (Tax Update 3º Delivery 2017)
  • Changes to react to RED Bulletin 2016/02 regarding Social Security calculation and Cret@ reporting of employees affected by multiple-employment when they have excluded contingencies in the other company (Tax Update 4º Delivery 2017)
The Position Statement has been updated with details of these Tax updates. We advise customers to review the position statement to keep up-to-date.
